Is a payday loan legal?

A lot of people are not entirely clear if payday loans are legal. This is because there is a lot of talk about how exploitative they are. Clearly there are issues with payday loans and many people would like to see them outlawed, but in general this has not happened yet in most places. Although that could change in the near future.

Whether or not a payday loan is legal is going to depend on where you live. In most places it is but there are a number of states that have introduced laws to ban them. It will be pretty easy to tell if you live in one of those states since you won't see stores that offer them. In most places there are stores on every corner that offer payday loans, if you don't see them where you live there is a pretty good chance that you live in one of the states where they are not allowed.

The reason that states have started banning payday loans is that they are seen by a lot of people as being exploitative. Generally they target people who have no other options for borrowing money and offer loans with terms that make the loan very expensive. Even worse these loans often result in borrowers getting stuck in a cycle where they have to keep taking new loans because they use most of their paycheck to pay off the old ones. In order to protect people some states have simply banned payday loans.

An interesting thing has started to happen in some of the states that were among the early ones to ban payday loans, they are starting to allow them again. Experience has taught them that although payday loans are not a good way to borrow money for a lot of people they are the only option available. As a result there is now something of a trend for states that outlawed payday loans to start allowing them again. Of course there are other states that are moving towards banning them so the laws are all mixed up, this is a good indicator of how complicated the issue is.

One thing that has become very common is that the states that do allow payday loans are making the rules more restrictive. This is designed to ensure that the consumer has some level of protection. However in states where the rules have become too restrictive the lenders have simply closed up shop and stopped offering the loans. Obviously they are not going to stay in business if it isn't profitable. It has become apparent that it will be necessary for the states and the payday loan lenders to work together to come up with a plan that ensures that consumers who need these loans are able to get them but do not become stuck in a cycle of constantly having to take out new loans.
